The Service, available at the time of purchase, provides the End User the right to re-download the downloadable Product(s) purchased from www.astrogemini.com, for the sole purpose of reinstalling a replacement copy of such Product(s) on the End User's computer in the event the End User has reformatted his/her hard drive, inadvertently uninstalled the Product(s), changed computers or other similar situation.

Such right to re-download shall apply to all the Product(s) purchased by the End User from Astro Gemini. The re-downloaded Product(s) shall be considered a replacement of the originally purchased product(s) and will continue to be subject to the applicable product End User License Agreement ("EULA").

To use DS, the End User must follow instructions provided in an Order Confirmation e-mail that is sent to the End User upon completion of his/her order. The End User should print and retain a copy of the Order Confirmation e-mail along with appropriate RegNow OrderID #s for his/her records.

ASTRO GEMINI MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER WITH RESPECT TO THE SERVICE AND/OR THE PERFORMANCE OF THE PRODUCT; INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ASTRO GEMINI DOES NOT WARRANT, GUARANTEE OR MAKE ANY REPRESENTATION REGARDING THE USE, OR THE RESULTS OF THE USE, OF THE SERVICE AND/OR THE PRODUCT IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SERVICE AND THE PRODUCT IS ASSUMED BY THE END USER. ESELLERATE SHALL NOT BE LIABLE TO THE END USER FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING FROM THE BREACH OF ANY WARRANTIES, THE FAILURE OF DELIVERY, DELAY IN DELIVERY, DELIVERY IN NONCONFORMING CONDITION, THE USE OF THE SERVICE AND/OR THE PRODUCT, OR FOR ANY OTHER BREACH OF CONTRACT OR DUTY BETWEEN ANY PARTIES.

Astro Gemini shall have no obligation to provide the Service, and shall have no liability to the End User in the event Astro Gemini is unable, as may be determined in the sole discretion of Astro Gemini: to make multiple downloads of the Product(s) available as a result of modifications or changes to the End User's computer system which make it incompatible with the downloading process, changes or modifications to the Product(s) that render the Product(s) unsuitable for downloading, changes in methods of Internet access or operation that make the Product(s) unsuitable for downloading, any other change or modification to technology and/or the Internet that makes the Product(s) unsuitable for downloading.

Effectiveness of Agreement

The End User's use of the Service shall not in any respect whatsoever modify any of the terms, conditions, or restrictions contained in the license agreement or other agreement by which the End User initially acquired rights to use the Product(s) (the End User License Agreement or EULA), and the use of the Product(s) downloaded in connection with the Service shall in each and every instance remain subject to the terms, conditions, and restrictions contained in the End User License Agreement or EULA.

General

The laws of the Russian Federation shall govern this Agreement. Any litigation or other dispute resolution between the parties relating to this Agreement or its construction shall take place in a court of competent jurisdiction in the Russian Federation.
